Farm and Ranch Documents


The sale and purchase of farm and ranch property presents many unique circumstances, and oftentimes, challenges.  A few of the areas which must be addressed by contract include:

  • mineral reservations and surface rights
  • crops
  • access
  • water rights
  • boundaries
  • surveys
  • location of improvements
  • location of fences
  • location of rivers, creeks and roads
  • cemeteries and burial sites
  • and Section 1031 exchanges of property.


Real estate attorneys often draft custom contracts for the sale and purchase of farm and ranch property.  And the Texas Real Estate Commission (TREC) also promulgated an earnest money contract for the sale and purchase of farms and ranches, the "Farm and Ranch Contract".  The goals and concerns of the seller differ dramatically from the goals and concerns of the buyer.
