Is your Will a Ticking Time Bomb?

By Thomas Rose | Tue, 16 Dec 2008

Never permit a legal secretary to draft your Will, even if she is a friend or relative!  This gem of drafting resulted in the surviving spouse's loss of the deceased spouse's interest in a tract land valued at approximately $75,000 when the surviving spouse unwittingly remarried several years later (an earlier provision in the probated Will gave the deceased spouse's entire estate to the surviving spouse; leaving one with the distinct impression that you can win after you're gone.

"After the death of myself and [the surviving spouse], this Last Will and Testament will not be changed after either one of our deaths and both of us remain widow/widower.  If either one of us remarries all inheritance shall go soley (sic) to our children."
