Administratrix


What is an Administatrix?

An administratrix is a woman appointed by a court with probate jurisdiction to manage the estate of a person (a) who died without a will (that is, "intestate," or "without a will"; or (b) who died with a will but the will failed to name an executrix; or (c) the will failed to name a successor executrix and the primary executrix has died, or refuses to serve, or has been removed by the court.

Applicable law and the probate court judge will almost always require that the administratrix post (that is, file) an acceptable bond normally issued by an insurance company to protect the estate from mismanagement or wrongdoing.

If the deceased person owned land or a home in state other than Texas, then someone must manage and probate the assets located in that state, and a woman who serves in this capacity is often called an "ancillary administratrix."

The word "dependent" denotes that all of the appointed administratrix’s actions are directed and supervised by the probate court in accordance with applicable Texas law.
